GENERAL TERMS AND CONDITIONS OF SALE
The commercial website " unique-yacht.com " is operated by UNIQUE-YACHT, having head office at
165 Chemin du Causse de Veauzac, 12200 Villefranche de Rouergue en France and registered at the
RCS of Rodez under the number 753031764 00024 and VAT number FR307531764
The general conditions of sale detailed below are governed by French law, and apply to all orders
placed with the company UNIQUE-YACHT for all products offered on the site "unique-yacht.com",
unless otherwise agreed in writing.
The present general conditions of sale are available on the website at any time.
1) ITEM 1 - SUBJECTS
These General Terms and Conditions apply exclusively to the selling of products performed by
UNIQUE-YACHT, 165 chemin du causse de Veuzac, 12200 Villefranche de Rouergue, France
2) ITEM 2 – PRICE
All prices are indicated in Euros all taxes included (French TVA (20%) and any other applicable taxes
on the day of the order)
The prices of our products are indicated in euros all taxes included (VAT and any other applicable
taxes on the day of the order), unless otherwise indicated and excluding processing and shipping
fees.
If you are eligible for tax-free products, you must provide to UNIQUE-YACHT a copy of the ship’s
registration at the same time as the order is placed. Please note that we won’t be able to do tax-free
retrospectively.
The company UNIQUE-YACHT reserves the right to modify its prices at any time, but the product will
be invoiced based on the rate in effect at the time of order validation and subject to availability.
The products remain the property of the company UNIQUE-YACHT until full payment of the price.
Warning: as soon as you physically take possession of the ordered products, the risk of loss or
damage to the products is transferred to you.
3) ITEM 3 - ORDER

You can prepare your basket and we will come back with quote.
Quote are valid for 30 days upon receipt by you. On expiry of this period new terms may apply. Once
accepted by the client, prices are final.
Any change of address or contact information including management companies must be send to
UNIQUE-YACHT by e-mail to stephanie@unique-yacht.com;
Any samples requested will be charged at retail price and the price of the samples will be discounted
from the first order when these references are purchased on any orders over 500 Euros HT. Shipping
cost are as in ITEM 7.
The company UNIQUE-YACHT reserves the right not to record a payment and not to confirm an order
for any reason whatsoever, particularly in the event of supply problems or difficulties regarding the
order received.
4) ITEM 4 – VALIDATION OF YOUR ORDER
Any order placed on the website unique-yacht.com implies full acceptance of these General Terms
and Conditions. Any order confirmation implies your full acceptance of these general conditions of
sale, without exception or reservation.
All the data provided and the confirmation recorded will constitute proof of the transaction.
You declare that you have perfect knowledge of it.
The order confirmation will be deemed to be signature and acceptance of the operations carried out.
A summary of the information of your order and these General Terms and Conditions will be
communicated to you in PDF format via the confirmation email of your order.
5) ITEM 5 – PAYMENT
The first order need to paid in full when confirming the order. For the next order, it’s 50 % when
confirming the order and 50% on delivery.
In case of non-payment, the products will not delivery.
Validating your order implies an obligation on your part to pay the indicated price.
All late payments will be subject to a penalty of three times the legal rate interest according to
French commercial regulation art L441-6
Payment for your purchases is made by bank transfer by credit card through the secure system or by
check.
The card will only be debited at the time of shipment of the order.
6) ITEM 6 - AVAILABILITY
The products availability will be indicated on the quote that will send you.
7) ITEM 7 – DELIVERY
Products are delivered to the delivery address indicated during the order process.
All deliveries will be quoted and the time delay will be indicated.
In the event of a delay in shipment, an email will be sent to inform you of any possible consequence
on the delivery time indicated to you.
In the case of deliveries by a carrier, the company UNIQUE YACHT cannot be held responsible for late
delivery due exclusively to the unavailability of the customer after several appointment proposals.
8) ITEM 8 - WARRANTY
All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects,
provided for by articles 1641 and following of the Civil Code. In the event of non-conformity of a
product sold, it can be returned, exchanged, or refunded.
Unless products were supplied incorrectly, any returns will be subject to a 20% re-stocking charge
based on the purchase value of the goods returned. If the products arrive damaged, all return costs
are your responsibility.
If any products are broken or defective, all original packaging must be retained to UNIQUE YACHT.
If the problem is the result of a manufacturing issue or shipping error, we will replace the product
with not additional cost to you.
You shall examine the products within 48 hours of delivery. If there is any defect in products, you
must be notify within 7 days of delivery by Email: stephanie@unique-yacht.com
It is your responsibility to note on the carrier’s delivery papers any damage to the products or
packaging which is immediately obvious on delivery. We don’t accept liability for damage to the
products in transit where you have not drawn to the carrier ‘s attention such damage on delivery.
Our liability shall be restricted to the cost of products.
9) ITEM 9 - LIABILITY
The products offered comply with French legislation in force. The responsibility of the company
UNIQUE-YACHT cannot be engaged in case of non-compliance with the legislation of the country
where the product is delivered. It is your responsibility to check with the local authorities the
possibilities of importing or using the products or services that you intend to order.
Furthermore, the company UNIQUE-YACHT cannot be held responsible for damages resulting from
misuse of the purchased product.
Finally, the responsibility of the company UNIQUE-YACHT cannot be engaged for all inconveniences
or damages inherent in the use of the Internet network, in particular a service interruption, an
external intrusion, or the presence of computer viruses.
10) ITEM 10 – APPLICABLE LAW IN CASE OF DISPUTES
These terms of sale are subject to French law. In case of dispute, French courts will have sole
jurisdiction.
11) ITEM 11 – INTELLECTUAL PROPERTY
All elements of the website unique-yacht.com are and remain the intellectual and exclusive property
of the company UNIQUE-YACHT. No one is authorized to reproduce, exploit, redistribute, or use in
any capacity, even partially, elements of the website whether they are software, visual, or sound.
Any simple or hypertext link is strictly prohibited without express written consent of the company
UNIQUE-YACHT
12) ITEM 12 – PERSONAL DATA
The company UNIQUE-YACHT reserves the right to collect personal information and data about you.
They are necessary for the management of your order, as well as for improving the services and
information we send you.
They can also be transmitted to companies that contribute to these relationships, such as those
responsible for the execution of services and orders for their management, execution, processing,
and payment.
This information and data are also kept for security purposes, in order to comply with legal and
regulatory obligations.
In accordance with the law of January 6, 1978, you have the right to access, rectify, and oppose
personal information and data concerning you, directly on the Internet site.
13) ITEM 13 – ARCHIVING PROOF
The company UNIQUE-YACHT will archive purchase orders and invoices on a reliable and durable
medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil
Code.
The computerized records of the company UNIQUE-YACHT will be considered by all parties
concerned as proof of communications, orders, payments, and transactions between the parties.
